the following is from Jayski (but I first heard it mentioned by Bob Dilner on the Speed Report)

Sauter and Kyle Busch Fail Post Race Inspection: The Chevy's of #70-Johnny Sauter and #5-Kyle Busch both did not meet the minimum height requirements during post-race inspection. #83-Brian Vickers failed post-qualifying inspection on Friday and had his time disallowed. NASCAR will take both of the cars back to the R&D Center in Concord, NC to test them further to see if the problem is the result of something that happened on the track or not. If any penalties are assessed, they will be announced on Tuesday.(7-1-2007)

I agree HH.

I also think if th #5 car is too low on purpose then R.Hendrick will see the WRATH of Nascar come down on him lol.

I will say it again, Send Them HOME and they will NOT cheat again.

It's only "cheating" when they get caught.

Where does innovation end and "cheating" begin.
The Rule Book, I think, says if it ain't in the Rule Book ---
It's Illegal.
Since there's more NOT in the Rule Book than there is IN it, I'm surpirsed that there aren't MORE post-race inspection/detection failures.


And while Nero fiddles (about)

Kyle Busch and Sauter have each been penalized 25 driver championship points. Their respective crew chiefs -- Alan Gustafson and Robert "Bootie" Barker -- have each been fined $25,000 and placed on probation until Sept. 19.

WTF? they found illegal parts on both cars and now it's only 25 points and $25.000 so much for fairness I guess they didn't want a little fish likeJohnny sauter to fall out of the top 35

They didn't find illegal parts on the car, the car failed to meet the minimum front car heights when they finished the race so it didn't conform to NASCAR rules at that point.  Not the same thing as massaging fenders and using illegal parts to gain a competitive advantage.

Ren's 100% right on this one...
Having a spring collapse more than expected and a car end up lower then what you expect is a far FAR cry from what HMS did with changing the shape of the fenders, and trying to gain an advantage.
IMO the penalties for both 'fit the crime" (Maybe HMS was too light if anything compared to the #8 and the rear wing)
In any event... the violations are apples and oranges between HMS and the #5 / #70

If people remember back a few years ago.. teams had pring fail and end up a little low when they went through the height sticks.  25 points, and 25 grand was the common penalty then also.
This looks to be pretty consistent with then, and the process of seeing if there may be some problem with the car or how it reacts...??

Yeah, the way to cheat and get this to happen is to put a spacer in the springs that will disintegrate and let the car drop down once the race is underway. I believe that that's the reason they check heights several times over the weekends now since that was done in the past.

I guess hydraulics would be completely out of the question!
